M3: Describe legal and ethical considerations required to comply with regulatory bodies for an original radio programme
You should be able to describe legal and ethical issues that relate to your new radio programme. This should ensure that you comply with the regulatory requirements connected to any legal and ethical issues.
Legal issues I need to be aware of:
Copyright: This is one if the main legal issues I need to be aware of when producing my radio show, as it Is extremely important to ask for permission of any of the content I use which I don't own, this can be done through a signed agreement. For my radio production, I will need to gain a PRS and PPL license agreement, this is so I can use any of the songs I wish as long as they follow the OFCOM regulations. This is to protect my audience as they rules ensure that the language used is safe for all audiences.
Deformation of character: As my radio show is on a celebrity ( Liam Gallagher ) I cannot put Liam Gallagher in a bad light for any actions he has taken in his life. Or in fact being libel ( is when you say anything about someone which isn't true or proven. This is because it could effect how the person is perceived and effect how people think about them. ) about saying anything that isn't true, if I was found to be libel upon the celebrity I speak about in the show I could be fined. So when producing the ready show I need to make sure all facts and information I state in the program is 100% accurate and backed up with evidence
Discrimination: In my radio programme I cannot discriminate anyone for thier age, race, religious beliefs or sexual identity as this is against the law and does not obey by OFCOMS regulatory outlines, If I was found to be discriminatived to anyone I would be fined and prosecuted. I will ensure that I follow these rules when producing my radio show, which will mean that my content will be suitable for people of all ages and won't cause any offence to any of my audience.
Data protection act 1988: The data protection act of 1988 stops any of the personal information collated being used, meaning any personal information such as where the person lives to their telephone number cannot be released without that persons permission. No personal information will be used in the radio show. To make sure I follow these rules, I will make sure I read through the data protection act to see if my content which I have produced does not break any of these rules.
Ethical issues to be considered: I need to make sure when discussing any stories that I have different viewpoints on topical subjects so it adhered that there are a range of opinions in the show. As the person I am talking about it is very controversial in regards to what he says I need to be careful what I say and produce in the show so that my audience won't be offended.
